These General Terms and Conditions of Sale and Use of the Website apply exclusively to the products marketed by Blue Collars S.r.l. (“Seller”) through the website candianidenim.com (“Website”).

Customers accessing the Website candianidenim.com (“Customer”) must read these General Conditions carefully before making any purchase. For any legal information, Customers may also consult the sections: Privacy Policy and Right of Withdrawal.

DEFINITIONS

1. “Online sales contract” refers to the distance contract for the sale of products between the Seller and the Consumer through telematic means organized by the Seller.
2. “Customer” or “Consumer” refers to the consumer making the purchase.
3. Subject of the Contract: Under this contract, Blue Collars S.r.l. sells and the Consumer purchases remotely, through telematic means, the Products offered on candianidenim.com.

1. GENERAL PROVISIONS

1.1. The purchase of products via the Website is permitted only to Customers aged 18 or older who have legal capacity and qualify as consumers.

1.2. “Consumers” are natural persons acting on the Website for purposes unrelated to business, entrepreneurial, craft, or professional activity.

1.3. Minors and/or non-consumers and/or those without legal capacity must refrain from purchasing from this Website.

1.4. These Conditions apply to all Consumer Customers equally.

1.5. These General Terms are governed by Italian law, particularly the Italian Consumer Code (Legislative Decree 206/2005) and Legislative Decree 70/2003 on electronic commerce. Mandatory consumer protection rules in the Customer’s habitual residence remain applicable.

1.6. The offer and sale of Products applies exclusively to shipments to countries listed in the “Countries List” available on the Website.

1.7. The Seller may impose purchasing limits on products or product categories.

1.8. The Seller reserves the right not to process orders from non-consumers, minors, persons without legal capacity, or from countries not included in the Countries List, and orders not aligned with commercial policy.

1.9. The Website may contain links to third-party sites; Blue Collars S.r.l. has no control over them and accepts no responsibility for their accessibility or content.

2. PURCHASES ON THE WEBSITE

2.1. To purchase Products, the Customer must select them and add them to the cart, then complete and submit the online Order Form by following the Website instructions.

2.2. Customers may purchase via personal account or as Guests. Guest Users must provide required personal data.

2.3. Before purchasing, the Customer must read these Terms, the Privacy and Cookie Policy, and the Right of Withdrawal notice. After completing the purchase, Customers are invited to print or save a copy.

2.4. Customers may always view Seller contact details before concluding the contract.

2.5. The order sent by the Customer constitutes a binding contractual purchase proposal and implies full knowledge and acceptance of these General Terms of Sale, Website Use, Payment Conditions, the Right of Withdrawal notice, and the Privacy and Cookie Policy.

Transmission of the Order Form entails the obligation to pay for the ordered Products and shipping costs. Any customs duties are exclusively borne by the Customer.

If the Customer chooses in-store pickup at Piazza Mentana 3, Milan, the Seller will notify them by email when the order is ready. The order will remain available for fourteen (14) working days. Pickup must be made personally; no proxies are allowed.

Receipt of the Customer’s proposal is confirmed via automated email sent to the address provided, reiterating all submitted data. The Customer must verify the accuracy and promptly report any corrections.

2.6. The purchase contract is concluded upon acceptance of the order by Blue Collars S.r.l., communicated through the Order Confirmation email, printable and containing the order number. As required by the Italian Consumer Code, the Order Confirmation includes: essential product characteristics, price, payment method, expected delivery date, delivery costs (excluding customs duties), conditions for exercising the right of withdrawal, complaint address, after-sales service information, existing warranties, and these General Terms.

2.7. The contract is not concluded without the Seller’s acceptance.

2.8. The Seller may refuse purchase orders due to: product unavailability, incomplete or incorrect orders, insufficient solvency guarantees, or orders contrary to commercial policy. In such cases, the Customer will be notified within 30 days, and any payment refunded.

2.9. After receipt of the Order Confirmation, the order may no longer be modified. Only standard jeans may be returned according to Article 8. No withdrawal is permitted for customized jeans.

2.10. Registered Customers may view their orders through their account. Guest Users may consult order confirmation emails.

3. PRODUCT PRICING

3.1. The Website displays for each product: image, unit price, color, and size. Images are illustrative; actual appearance may differ. Blue Collars S.r.l. is not responsible for graphical discrepancies.

3.2. Unless otherwise stated, all product and shipping prices on the Website and in the Order are expressed in euros and include applicable taxes. Customs duties are excluded and borne exclusively by the Customer.

3.3. Prices shown are valid only at the moment the Order is submitted. Prices may change without notice. If a pricing error is detected after order confirmation, the Seller will reject the order and allow the Customer to reconfirm at the correct price or cancel. If the Customer cannot be contacted, the order will be considered cancelled.

3.4. All Products ship from Italy. Prices exclude import duties for shipments to non‑EU countries or countries requiring import fees. Import duties cannot be estimated in advance and are always borne by the Customer. EU deliveries are not subject to customs duties. Customers must contact local customs authorities for information.

4. WARRANTY FOR CONSUMER CUSTOMERS

4.1. All Products sold by the Seller to Customers are covered by a two-year legal warranty for lack of conformity, pursuant to Italian law. “Consumers” are natural persons, aged eighteen or older, acting on the Website for purposes unrelated to business, entrepreneurial, craft, or professional activity.

4.2. The lack of conformity must be reported to the Seller within two (2) months of its discovery. The Customer may request repair or replacement of the Product free of charge, unless the requested remedy is impossible or excessively costly compared to the alternative. In that case, the Customer is entitled to a price reduction or termination of the sales contract, pursuant to Article 130 of the Italian Consumer Code.

6. PAYMENTS

6.1. Accepted payment methods are indicated during checkout. All payments are processed independently by third‑party services. The Website does not store payment information such as credit card numbers, expiration dates, security codes, or passwords; it only receives confirmation that payment was successful.

6.2. Payment may be made by:
- credit card, using accepted brands,
- PayPal.

Unavailable payment methods will be indicated at the beginning of the purchase procedure or, at the latest, before completing the order.

6.3. Blue Collars S.r.l. uses Shopify Payments. Credit card or PayPal account data is encrypted and transmitted directly to the payment processor, without passing through or being stored by Blue Collars S.r.l.

6.4. Customers choosing PayPal will be redirected to www.paypal.it to authorize payment under PayPal’s terms. Data entered on PayPal’s site is managed directly by PayPal and not transmitted to the Seller. Blue Collars S.r.l. is not liable for damages arising from use of PayPal services.

6.5. If payment fails, the order is cancelled and no Products will be delivered. The Seller will notify the Customer via email.

6.6. Payment methods available on the Website form an integral part of these Terms.

6.7. Product prices and shipping fees (excluding any customs duties) are charged upon receipt of the Customer’s Order. Early payment does not affect legal rights under these Terms.

7. SHIPPING AND DELIVERY OF PRODUCTS

7.1. Under applicable law, the maximum delivery time for standard Products is 30 days from conclusion of the contract, except in cases of force majeure. For customized Products, delivery may exceed 30 days, and will follow the estimated delivery date indicated on the Product page.

If the Seller fails to deliver within the above period, the Customer must request delivery within an additional appropriate period. If the Seller still fails to deliver, the Customer may terminate the contract.

7.2. Products are delivered on business days to the address provided in the Order Form via courier. If selected, the Customer may collect Products at the Candiani Denim Store in Milan. Shipping fees are shown separately in the Order Form.

Upon delivery, the Customer must verify that packaging is intact and undamaged. Any anomalies must be reported to the courier and the parcel refused or accepted with reservation. Otherwise, the Customer may lose related rights.

7.3. Orders placed from a section of the Website corresponding to a country different from the delivery destination, or to an address not served by the Seller’s courier, will not be accepted.

8. RIGHT OF WITHDRAWAL

8.1. The Consumer Customer (defined as any natural person acting for purposes unrelated to business, entrepreneurial, craft, or professional activity) may withdraw from the purchase of standard Products within fourteen (14) calendar days from the date of receipt, without penalties and without providing any reason. The date on the courier’s delivery receipt applies.

Under Article 59 of the Italian Consumer Code, the right of withdrawal is excluded for customized or made‑to‑measure Products, including—by way of example and not limitation—Products featuring numbers, letters, names, or embroidery requested by the Customer. The right of withdrawal is also excluded for Products created according to the Customer’s specific instructions.

Therefore, the right of withdrawal does not apply to customized jeans.

To exercise the right of withdrawal, the Customer must notify the Seller in one of the following ways:
a. Submitting the online withdrawal form (fully completed). The Seller will confirm receipt via email;
b. Sending the completed standard withdrawal form by post to:

c. Sending a clear written statement expressing the intention to withdraw, via email, certified email, or postal mail, including product details, quantities, full name, postal address, order number, and—if possible—telephone number and email address.

8.2. The Customer bears the burden of proving correct and timely exercise of the right of withdrawal.

8.3. The Customer must return the Product(s) within fourteen (14) days from the withdrawal notice, by shipping them to:

Alternatively, the Customer may return the Product(s) directly to the Candiani Denim Store.

Returned Products must be accompanied by the list of items indicated in the Seller’s email notifying shipment.

8.4. Each Product must be returned intact, with original packaging or packaging suitable for transport. If the Product is depreciated due to handling beyond what is strictly necessary to inspect its nature, characteristics, and size, the Seller may refuse reimbursement. Tags and labels must remain attached.

8.5. Return shipping costs—including any customs duties and clearance fees—are entirely borne by the Customer.

Packages sent at the Seller’s expense will not be accepted.

The Seller is not responsible for transport costs, customs duties, or damage/loss caused by third parties. Any customs costs charged to the Seller will be deducted from the refund.

8.6. Conditions for valid withdrawal:
a. Withdrawal must be exercised within 14 days from receipt of the Products;
b. Products must be handed to the courier within 14 days after notifying the Seller;
c. All original tags and labels must be present;
d. Products must not be washed, used, or show signs of wear or dirt; shoes must have perfectly intact soles;
e. Products must be returned in original packaging or equivalent;
f. Products must not be damaged.

Withdrawal is excluded for customized or made‑to‑measure Products under Article 59 of the Consumer Code.

8.7. The Seller will verify compliance of returned Products with the above conditions.

8.8. If verification is successful, refund will be issued in the same currency used for the purchase, within fourteen (14) days of receiving the returned Products or proof of shipment—whichever comes first. Refunds will be made using the original payment method.

8.9. After receiving the return, the Seller will email the Customer confirming acceptance, refusal, or a partial refund due to diminished value.

If the return is refused or partially refunded, the Customer has 20 days from the Seller’s notification to request, at their own expense, the return of the Products in the condition they were received by the Seller. Otherwise, the Seller will retain the Products.

8.10. Refunds are issued using the same payment method used by the Customer.

If the payer and the recipient differ, the refund will be issued to the payer.

9. PRIVACY

9.1. Customers may obtain information about the Seller’s processing of personal data by consulting the Privacy Policy.

10. APPLICABLE LAW, DISPUTE RESOLUTION, AND JURISDICTION

10.1. Without prejudice to mandatory consumer protection rules in the Customer’s country of residence, these Terms are governed by Italian law, particularly the Consumer Code and Legislative Decree 70/2003 on electronic commerce.

10.2. If any clause is deemed invalid or unenforceable, such clause shall be considered separable and shall not affect the validity of the remaining provisions.

10.3. Consumers may submit online dispute resolution requests through the European ODR platform at http://ec.europa.eu/consumers/odr/, pursuant to Legislative Decree 130/2015 and EU Regulation 524/2013.

10.4. Disputes concerning interpretation, validity, or enforcement of these Terms shall be subject to the jurisdiction of the court of the Customer’s residence or domicile, or—at the Customer’s choice—the Court of Busto Arsizio.

11. AMENDMENTS AND UPDATES

11.1. Without prejudice to Article 49, paragraph 5 of the Italian Consumer Code, Blue Collars S.r.l. may amend or update these General Terms and Conditions of Sale at any time, including to reflect regulatory changes. Customers will be required to accept only the version in force at the time of purchase.

New Terms become effective from their publication on candianidenim.com and apply only to purchase orders submitted thereafter.
